PERM Labor Certification for Doctors

Labor certification is a process by which an employer “tests” the U.S. labor market prior to offering a permanent position to a foreign worker (including a foreign doctor). Under the Program Electronic Review Management (PERM), as administered by the U.S. Department of Labor (DOL), the employer may submit a labor certification electronically after completing a recruitment plan to demonstrate that there are no qualified U.S. workers who are willing and available to take the job opportunity. The date of filing the PERM application will be the foreign worker’s priority date for purposes of applying for a green card.
